1. About BFSENTAIN Technologies

BFSENTAIN Technologies (Private) Limited is a technology holding company incorporated in Zimbabwe. We design and build mobile applications, web platforms, SaaS products, AI integrations and payment systems. Our registered office is in Harare, Zimbabwe.

2. Use of This Website

By accessing bfsentain.com, you agree to use the site lawfully and in good faith. You may not:

• Reproduce or redistribute our content without written permission
• Use the site to transmit harmful, fraudulent or illegal content
• Attempt to gain unauthorised access to any part of our systems
• Misrepresent your identity or affiliation when contacting us

3. Client Services

All client engagements are governed by a separate, signed Service Agreement. These Terms of Service apply in addition to any such agreement. In the event of a conflict, the signed Service Agreement takes precedence.

• Proposals — all project proposals are valid for 30 days from the date of issue unless otherwise stated
• Scope — work is delivered as defined in the agreed project scope. Changes to scope require a written change order
• Payments — invoices are due as per the payment schedule in the Service Agreement. Late payments may incur a 5% monthly surcharge
• Revisions — revision rounds are as specified per project. Additional revisions beyond the agreed number are billed at our standard hourly rate

4. Intellectual Property

Upon full payment of all invoices, intellectual property rights for custom-built deliverables transfer to the client as specified in the Service Agreement. Until full payment is received, BFSENTAIN Technologies retains all rights to the work.

• BFSENTAIN Technologies retains the right to display completed work in our portfolio unless the client requests otherwise in writing
• Our internal tools, frameworks, libraries and methodologies remain the property of BFSENTAIN Technologies at all times
• Third-party licences (fonts, stock assets, APIs) remain subject to their respective licence terms

5. Confidentiality

We treat all client information as strictly confidential. We do not disclose client business details, project specifications or proprietary information to third parties without written consent. Clients are encouraged to sign our NDA for sensitive engagements.

6. Warranties and Liability

BFSENTAIN Technologies warrants that services will be delivered with reasonable skill and care in accordance with industry standards. We do not warrant that deliverables will be error-free under all conditions.

• We are not liable for indirect, consequential or incidental losses arising from the use of our deliverables
• Our total liability to any client shall not exceed the total fees paid for the specific project in question
• We are not responsible for third-party service outages (e.g. Firebase, Cloudflare, payment processors)

7. Termination

Either party may terminate a service engagement with 14 days written notice. Upon termination:

• The client pays for all work completed to the termination date
• BFSENTAIN Technologies delivers all completed work and assets to the client
• Any confidentiality obligations survive termination indefinitely

8. Governing Law

These Terms of Service are governed by the laws of the Republic of Zimbabwe. Any disputes arising from these terms or any client engagement shall be subject to the jurisdiction of the courts of Harare, Zimbabwe.

9. Changes to These Terms

We may update these Terms of Service from time to time. The effective date at the top of this page reflects the most recent version. Continued use of our website or services after changes constitutes acceptance of the updated terms.
